At Stirling the twenty second day of September Eighteen hundred and twenty years In presence at Supra Compeared Robert Campbell writer in Stirling and produced c/- and whereof the tenors follow vis Inventory of the personal Estate of Dougald ForbesEsquire late of the Island of New Providence one of the Bahama Islands thereafter residing at Melville place near Stirling who died on the ninth day of January in the year Eighteen hundred twenty years.

1st. Interest from the term of Martinmas 1819 to the defuncts death upon the sum of £10,000 Sterl. Contained in an heritable bond granted by Robert Humphreys and Company to the deceased over certain subjects in Glascow dated 20th Nov. 1817 the interest being payable at the terms of Marts. And Whits by equal portions. £80 /16/5

2nd.Interest for the like period for £2000 Sterl. contained in another heritable bond granted to the deceased over certain subjects near Glasgow by James Campbell Esq. of Newtown lodge dated 27th Jany. 1814 the interest being payable at Marts. And Whits. In equal portions £16/3/4

3rd. Cash in the hands of the Stirling Banking Company £41/8/

4th Cash in the deceased writing desk and purse £9/7/6

5th The deceased household furniture bed and table linen plate wines and within his house at Melville Place and also his body cloaths and watch valued by Thomas Fraquair auctioneer in Stirling conform to Inventory and appraisement dated 17th Jany.1820 £413/4/4

(signed) Archibald Campbell, Esquire of Drumsynie one of the executors of the deceased Dugald Forbes Esquire residing at Melville place who being solemnly sworn & examined on oath depones that the said Dugald Forbes Esquire died upon the ninth day of January last & that the despondent along with Donald Campbell Esquire Merchant in Glasgow major Arthur Forbes in Stirling and William Glas Esquire Merchant there as executors nominated by the deceased in a trust deposition and settlement executed by him on the Tenth day of August Eighteen hundred & sixteen years Recorded in the Sheriff Court Books of Stirlingshire on the eighteenth day of January last ( an extract of which is now exhibited and signed by the despondent and commissary as relative hereto ) have entered upon the possession and management of the deceased personal Estate. That the desponent does not know of any settlement or writing relative to the disposal of the deceased personal Estate or effects or any part of them other than that now exhibited. That the said inventory each page of which is signed by the desponent andthe commissary as relative hereto is a full & complete Inventory of the personal Estate and effects of the said deceased Dugald Forbes wherever situated and belonging or due to him beneficially at the time of his death so far as known to the despondent & that the value of the said Estate situated in Scotland is of the value of four hundred & fifty pounds Stirl. And under the value of six hundred pounds Stirling all which is truth as the despondant shall answer to God. nine words on the preceeding page being delete before signing (signed) Archd. At Stirling the Eighteenth day of January Eighteen hundred and twenty years In presence of Ronald Macdonald of Staffa Esquire Advocate Sheriff Depute of Stirlingshire Compeared Robert Sconce Notary as prior for the persons afternamed and designed and produced and gave in the Trust Deposition and Settlement underwritten Desiring that the same might be inserted and registered in the said Sheriff Court books for preservation and publication conform to the clause of regis Ardtion therein which Desire the said Sheriff Depute granted & ordained the same to be done accordingly and whereof the tenor follows vers. I Dugald Forbes late of the Island of New Providence one of the Bahama Islands Esquire now residing at Melville place near Stirlinghaving resolved for the welfare of my family to execute a Trust settlement of all my Estates real and personal wherever situated Therefore wit ye me to have devised and made over as by these presents under the burdens, provisions, declarations andpower and faculty after expressed I do hereby Devise Make over, Assign and Convey, Alienate and Dispose from me my heirs and successors to and in favour of Robert Thomson Esquire of the Island of New Providence Archibald Campbell Esquire of Drumsynie, Donald Campbell Esquire his nephew Merchant in Glasgow, Alexander Campbell Esquire of Hallyards Merchant in Glasgow, Major Arthur Forbes in Stirling, and William Glas Esquire Merchant there and to the accepting survivors or survivor of them,the majority of the acceptors and surviving trustees or trustee being always a quorum and in case of the death or non acceptance of one or more of the said Trustees to and in favour of such other person or persons as the said accepting quorum or the survivors or survivor of them shall think proper to assume for the proper execution of this Trust, and so and in favour of such other person or persons as such assumed Trustees or Trustee may think proper to assume, and which the Trustees above named quorum or survivor of them as well as those to be assumed, quorum or survivor of them are hereby expressly empowered to do from time to time as they or he shall think proper a majority being always a quorum, and failing of such an assumption to and in favour of the last Trustee acting for the time all and Sundry lands heritages messuages and tenements with their rights, members, privileges and appurtenances wherever situated with all debts, funds and effects real, personal or mixed, and whole goods gear or sums of money, Bank stock, Government funds public or private household furniture of all kinds including plate china, bed and table linning, wines, liqueurs, prints , pictures, paintings and books and hesrship movableswhich shall be belonging to me at the time of my death whereever situated and of whatever nature the same may be, with the whole title deeds, Bonds, Bills, vouchers & other securities of the same, as also without prejudice to the said generalityAll and whole these two Estates situated and lying in Long Island one of the said Bahama Islands at present belonging to me with the whole appurtenaneess therof, the one at Culmers Cliff the rights of which stand in my own name, And the other at Alligator Bay to which I aquired right by my late spouse Mrs. Elizabeth Green otherwise Forbes and comprehending the one hundred acres or thereby adjoining thereto which were acquired by me from Parr Ross Esquire as alos all and whole that villa called Melville Place consisting of two roods eleven falls and six ells Scotch measure of the lands of Southfeed and marked No. 4 upon the plans together with the dwelling house, office houses garden and others sometime ago erected by me thereon, lying within the county of Stirling and at the East end of the Burg of Stirling bounded on the north by lote Number three faced by Miss. Colquhouns, on the south by lote Number five faced by James Wilson, and bounded on the East and West as delineatedon the said plan which subjects were purchased by me from the Magistrates of Stirling Patrons of Spittals Hospital conform to Dispositions from John Dick Senior Merchant Burgess of Stirling and John Hewit Taylor Burgess there, masters of the saidHospital in my favour bearing date the ninth day of December Eighteen hundred and Six, and my Instrument of Sasine thereon dated the thirteenth and duly recorded the seventeenth days of the said month and year together with all rights, title, interest, claim of right, property and possession which I my predecessors and authors had, have or can pretend to the subjects herein generally and particularly conveyed or to any part thereof : But in trust always for the uses, ends, and purposesunderwritten and with & under y Burdens, Provision, Declarations, Reservations, power & faculty after expressed vis. In the first place I Direct and appoint my said Trustees or Trustee to collect levy & uplift, or resign, convey, Discharge, Renounce, Sell or Dispose of the whole or any part of my property real, personal or mixed hereby conveyed and that either by public coup or private bargain as they or he may think proper (excepting always the sale of the said villa and furniture which is to be postponed for a certain period for the reason afterasigned) to receive the prices or take security for the same as may be deemed expedient and also to lend out and again employ the whole proceeds of my Estates real, personal or mixedor any part thereon either upon personal or heritable security or in the Government funds and again to call up and employ the same from time to time as they or he shall judge proper and with power to grant discharges, renunciations and all other writings needful in carrying this trust into execution. Item out of the proceeds of my said Estates funds and effects I appoint my said Trustees or Trustee to pay all my just and lawful debts, sickbed & funeral expense & to perform and implement allobligations incumbent on me to perform at the time for said. Item I appoint my said Trustees or Trustee to pay Mrs. Lilias Shaw in Argyllshire my niece one hundred pounds Sterling at the term Whitsunday or Martinmas which shall happen next after my decease with interest till paid. Item, I hereby Appoint and Direct my said Trustees or Trustee after paying such other legacies as I may appoint and after defraying all expenses consequent upon the management and execution of these presents to divide the free residue of the proceeds of my said Estate funds and effects among and unto my daughters Elizabeth, Mary (now Mrs. Birch), Sarah (now Ms. Campbell) Menzies, Cecilia and Jessy Forbes children procreated of the marriage between me and my late spouse Mrs. Elizabeth Green otherwise Forbes share and share alike and the survivors or survivor of them and I hereby Direct and appoint my said Trustees or Trustee to make payment to each of my said children of their said sharesat the expiry of a year and a day after my death or sooner if they can, but after the children respectively attaining the age of twenty one years or being married whichever of these two events shall first happen the child or children of any of them predeceasing being always entitles to their Father's or Mother's share thereof payable to such child or children immediately after the death of their Father or Mother But Declaring always as it is hereby expressly Provided and Declared that the said shares when ascertained shall be by my said Trustees or Trustee lent out upon good and sufficient security in the names of my said children and the securities taken payable to such of them as now are or shall happen to be married and to their husbands respectively and the longest liver of them in liferent for their liferent use allenarly and to the child or children to be procreated of their respective marriages in fee whom failing to the husbands and their heirs and assignees respectively. Declaring also that if any of my said children should die before becoming entitled to payment of the provisions above specified and without leaving lawful children in life the share or shares of such deceaser or deceasers shall fall, accresce and belong to the survivors or survivor of my said children equally among them hereby appointing my said Trustees or Trustee to make payment of the same accordingly to the child or children of any of them predeceasing being always entitled to their Father's or Mother's share thereof immediately after such death. Item I herby Appoint my said Trustees or Trustee not only to pay and to apply for the use and behoof of each of my said children the whole or any of the interest or annual proceeds of their provisions respectively as to them or him may seem proper and that from the first term of Whitsunday or Martinmas after my decease until they respectively receive their provisions. Declaring always as it is hereby specially provided andDeclared that the aforesaid villa, dwelling house and pertinents at Melville place household furniture books and plate and other articles that may happen to be therein at the time of my decease shall be continued in the possession of such of my said children as may be unmarried at that period aye and until they happen to be married and when such event may take place then the whole of the said villa and furniture etc shall be disposed of by public sale or private bargain as my said Trusteesor Trustee may see proper and the proceeds thereof equally divided amongst the whole of my children equally share and share alike and lent out on proper securities for their behoof in the manner above described. But Declaring that if my said Trustees or Trustee shall, from existing circumstances, be of the opinion that it will tend more to the benefit of my children to sell the aforesaid villa and furniture etc at any future period after my decease I hereby empower them or him to so do; butnot without the appropriation of the whole of my children that may happen to be unmarried at the time Declaring also that the person or persons who may purchase the whole or any part of my subjects hereby conveyed or those persons who may stand indebted to me at the time of my decease shall be noway concerned with the application of the price or prices or the sums of money when paid up but they, he, or she shall be fully exonored by the simple Discharge of my said Trustees or Trustee and likewise empower my said Trustees or Trustee to compound, transact and agree all questions, debates and differences relative to the said trust affairs or to submit and refer the same to arbitration which transactions and decisions to follow thereon shall be valid and effectual to all intents and purposes. Declaring also, as it is hereby specially Provided and Declared that the sum of Two thousand pound Stirling advanced by me to James Campbell Esquire my son in law and for which he granted anheritable Bond to me over his lands of Newton Lodge, the same with any other sum or sums of money I may advance or pay to or for him and as may appear from my Books or otherways, shall be imputed in part payment of that share of my Estate and effects herby disponed to him and his said spouse, my Trustees or Trustee always Discharging and Renouncing the said Heritable Bond after the application of its contents is made in manner above directed. In like manner I Declare that any sums of moneythat I have already paid or advanced, or may pay or advance to or for my other son in law John Birch Esquire as shall appear from my Books or otherways, the same shall be imputed in part payment of the share falling to him and his said spouse by virtue of these presents, which provisions before written concern in favour of the whole of my said children above named under the declarations and prescriptions aforesaid, I Declare to be and shall be of by them in full satisfaction of all bairns part of gear, legittim portion natural executry and everything else that they or either of them should claim or demand by and thro' my decease or in virtue of any contract of marriage between me and my said deceased spouse or in any other way whatever. And further I hereby authorise my said Trustees or Trustee to appoint either one of them their own number or any other person they may deem proper to be and to act as factor under them or him with such salaries as they shall think suitable Asalso I do hereby Nominate and appoint the said Trustees or Trustee or survivor of them not only to be my executors ad administrators of and with my whole personal and movable property, goods, gear and effects to the exclusion of all others, but also to be tutors and curators to such of my children as may be in minority at the time of my decease Granting and Committing to them or him all the powers and privileges competent to and bestowed upon executors and administrators and tutors and curators by law. Declaring that they shall not be liable for omissions of any kind nor for the insolvency of Factors or others whom they or he may employ, nor for the insolvency of persons to whom my said Trustees or Trustee may lend out monies for answering the ends & purposes of this trust further than that they were habit and respute responsal at the time; nor shall they be answerable for the intromissions of one another but each of them allenarly for his own actual intromissions, and I hereby Revoke and recall all former dispositions and settlements executed by me reserving always not only my own liferent of the whole subjects hereby conveyed but also full power and liberty to me to alter, revoke or burden these presents in whole orin part as I shall think fit at any time in my life and even on deathbed, but Declaring likewise that these presents in so far as not altered by me shall be good and valid tho' found lying by me at the time of my death or in the custody of any person to whom I may entrust the same hereby dispensing with the delivery hereof. And further and in order to complete a legal title in the persons of my said Trustees or Trustee in the aforesaid villa at Melville place I bind and oblige me, my heirsand successors validly to infeft & seise the said Robert Thomson, Archibald Campbell, Donald Campbell, Alexander Campbell, Arthur Forbes and William Glas and the survivors or survivor of them accepting; and any other Trustees or Trustee they or hemay assume for the ends or purposes before mentioned. To be holden the said subjects of the Magistrates & Town Council of the said Burg of Stirling or their successors in office as superiors thereof for the yearly payment of the feu duty and performance of the other articles and prestations incumbent on me by the original grant thereof Sicklike and as freely in all respects as I hold or might have held the same for myself and expeding the said infeftment by resignation I hereby Constitute and Appoint

And each of them conjunctually and severally my lawful and irrevocable procurators with full power and commission for me and in my name and behalf duly & lawfully to resign and Surrender All & Whole the aforesaid villa called Melville villa numberfour and whole pertinants thereof consisting, lying, and bounded as particularly before described and here held as repeated brevitatis causa in the hands of my immediate lawful superiors thereof or of their commissioners having power to receive resignations to grant new infeftments in favour & for new infeftment thereof to be made, given & granted to my said Trustees and their aforsaids in legal & proper form but in trust always for the uses ends and purposes and with & under the burdens, provisions, declarations, power and faculty before specified and to be applied or disposed of as above mentioned But with which application the purchaser or purchasers of the said subjects shall have no concern Further. I hereby Assign and Dispone to my said Trustees and their foresaids the whole writts and title deeds of the said subjects also the rents mails and duties thereof from and after my decease hereby warranting these presents and tittle deeds at all hands & as to the rents and duties from fact and deed and I consent to the Registration hereof in the Books of Council & Session or others competent for preservation and publication and thereto Constitute

My procurators and co Allour to the end my said Trustees & their forsaids may be infeft in the premises I herby Desire and Require you

And each of you my Ballies in that part conjunctually and severally hereby specially constituted that on sight hereof ye pays to the ground of the premises and there give and Deliver heritable state & sasine with real actual and corporal possession of All and Whole the foresaid villa called Melville place number four & whole pertinents thereof consisting, lying and bounded as particularly before described and here held as repeated brevitatis caused to the said Robert Thomson, Archibald Campbell, Donald Campbell, Alexander Campbell, Arthur Forbes & William Glas Esquires and to such other persons as vhey may assume and to the survivors to survivor of them and to their foresaids as qualified and distinguished in the dispositive clauseof these presents But in trust always for the uses ends and purposes & with & under the Burdens, provisions, declarations, reservations, power and faculty before specified & that by delivering to them or him or to their attorney or attorneys in their or his name bearers here of earth & stone of & upon the ground of the said subjects To be holden and for payment of the feu duty and for performance of the several articles and conditions and with under the restrictions and limitations all as particularly before written and which are hereby required to be inserted verbatim in the infeftments to follow hereon and in all the subsequent rights and titles thereof in all time coming.
